Terms and Conditions

These Terms and Conditions govern the contracting and provision of wine tourism services offered by D WINES TRAVEL via its website or booking channels. By confirming a booking, the user expressly accepts these terms and conditions, the Bookings, Cancellations and Refunds Policy, and all applicable legal provisions.

 

Obligations of D WINES TRAVEL

To provide the services described in the itinerary and on the tour page truthfully, in a timely manner and in accordance with the contract, including private transfers, guided tours, tastings and lunch (where applicable).
To guarantee the quality and safety of the services within reasonable industry standards.
To give advance notice of any significant changes to the itinerary due to force majeure (extreme weather, health restrictions, vineyard closures, etc.).
To be directly accountable to the user for any breach of contract, even when acting as an intermediary for vineyards or associated operators.
To process refunds, rescheduling or vouchers in accordance with the Cancellation Policy and the provisions on force majeure.
To respect the confidentiality of the user’s personal data in accordance with the Privacy Policy.
To comply with all legal obligations arising from Law No. 19.496 and other applicable regulations.

User (Customer) Obligations

The user undertakes to:

Provide accurate and complete information at the time of booking (name, contact details, number of participants, special requirements such as dietary restrictions or accessibility needs).
Make payment in accordance with the established terms and within the specified timeframes.
Arrive on time at the agreed meeting point, bringing the booking confirmation.
Comply with the rules of each vineyard (minimum age of 18 for alcohol tastings, appropriate behaviour, prohibition on the consumption of substances that may compromise safety).
Report any special needs (reduced mobility, allergies, health conditions) in good time so that feasibility can be assessed and reasonable adjustments made.
Follow the safety instructions and guidance provided during the tour.
Refrain from any actions that may damage the facilities or vineyards, or affect the experience of other participants.

Failure to comply with these obligations may result in exclusion from the tour without entitlement to a refund.

 

Service Features

Tours are conducted in small groups (maximum 8 participants) to ensure a personalised service.
The experience is of moderate difficulty and requires basic mobility. Accessibility is limited due to the historic nature of some wineries. Any mobility requirements notified in advance will be assessed on a case-by-case basis.
The tour includes only the services expressly detailed in the itinerary. Any additional services will be quoted separately.

Cancellation and Refund Policy

Our Booking, Cancellation and Refund Policy applies in full, including the express exclusion of the right of withdrawal.
In cases of force majeure, the customer may choose to reschedule at no cost, receive a voucher for the full amount (valid for 3 months) or a full refund, as appropriate.

Changes to the Itinerary

D WINES TRAVEL reserves the right to modify the itinerary for operational, weather-related or force majeure reasons, notifying the user as far in advance as possible and offering equivalent alternatives at no additional cost where appropriate.

Liability and Limitations

D WINES TRAVEL accepts no liability for:

Damage or loss arising from the user’s failure to disclose health conditions, dietary restrictions or accessibility requirements.
Incidents caused by a failure to follow safety instructions or inappropriate behaviour.
Loss, theft or damage to personal belongings during the tour.
Changes to the programme attributable to third parties (wineries) where all reasonable measures have been taken to prevent them.

The agency’s liability is limited to the total value of the tour booked, except in cases of wilful misconduct or gross negligence.

Acceptance of the Terms

Confirmation of the booking and payment imply express and full acceptance of these Terms and Conditions. Any enquiries or complaints must be submitted in writing within 14 days of the service being provided.

Applicable Law and Jurisdiction

These Terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the competent courts of Santiago de Chile.
